The MODIS Raw Radiance data are not available because these are not approved for public distribution. The Level 1B (M*D02*KM) are science quality data and approved for distribution.

No, MODIS Collection 5 (C5) data are already decommissioned and deleted from the archive, so cannot be downloaded. The latest version is C61 which you should be using:

The latency information provided in the table on the EarthData webpage are accurate. So, latency varies with type and level of a product, but generally between few hours to few days and in some cases (for higher level products) even a month or more.
